This Disclaimer governs the use of AQUANExT™, including its competition management systems, live scoring dashboards, mobile timekeeper applications, synchronization engines, and related services (collectively, the "Platform").

1. Live Scoring & Provisional Results

Results displayed through AQUANExT™, including live dashboards, mobile timing submissions, and ranking outputs, are provisional until officially validated and approved by authorized competition officials.

AQUANExT™ does not independently certify race outcomes unless explicitly designated as the official timing authority.

2. Mobile Timing Submission Risk

Timing data entered through mobile timekeeper applications is dependent on human input and device performance.

AQUANExT™ shall not be responsible for:

Incorrect manual time entry
Delayed submissions
Device malfunction
Battery failure
Network latency or connectivity issues
Duplicate or conflicting time entries

3. Third-Party Hardware & Infrastructure

Where third-party timing hardware, network infrastructure, or hosting services are used in conjunction with AQUANExT™, the Platform disclaims responsibility for failures, interruptions, or inaccuracies attributable to such third-party systems.

4. System Availability

While commercially reasonable efforts are made to ensure system uptime, AQUANExT™ does not guarantee uninterrupted availability.

Temporary suspension may occur due to:

Maintenance updates
Security patches
Server upgrades
Technical failures
Force majeure events

5. No Warranty

The Platform is provided on an "as-is" and "as-available" basis.

AQUANExT™ makes no express or implied warranties, including but not limited to:

Accuracy of competition results
Fitness for a particular purpose
Non-infringement
Uninterrupted operation

6. Limitation of Liability

To the maximum extent permitted by law, AQUANExT™ shall not be liable for indirect, incidental, consequential, special, or punitive damages arising from the use or inability to use the Platform.

Total liability, if any, shall be limited to the amount paid for the specific competition service in question.

7. Organizer Responsibility

Event organizers are solely responsible for:

Verification of participant data
Validation of official results
Ensuring compliance with governing sports bodies
Obtaining necessary participant consents

AQUANExT™ functions as a technology service provider and does not assume regulatory or officiating authority.

8. Force Majeure

AQUANExT™ shall not be liable for failure or delay in performance due to circumstances beyond reasonable control, including but not limited to:

Natural disasters
Government actions
Network outages
Power failures
Civil disturbances

9. Jurisdiction

This Disclaimer shall be governed by the laws of India.

Any disputes arising from or relating to AQUANExT™ shall be subject to the exclusive jurisdiction of the courts located in Pune, Maharashtra, India.
