Where required under applicable law, including the Digital Personal Data Protection Act, 2023 (India), affected event organizers and/or competent regulatory authorities shall be notified within a reasonable timeframe.

Event organizers are solely responsible for obtaining verifiable parental or guardian consent prior to submitting minor data to the Platform.

AQUANExT™ acts strictly as a technology service provider and shall not independently verify parental consent unless required by law.


15. Organizer Data Controller Responsibility

Event organizers using AQUANExT™ act as Data Controllers with respect to participant information.

AQUANExT™ acts as a Data Processor providing hosting, ranking computation, synchronization validation, and result publication services.

Organizers are responsible for:

16. Compliance with Digital Personal Data Protection Act, 2023

AQUANExT™ processes personal data in accordance with the Digital Personal Data Protection Act, 2023 (India), and applicable rules.

Processing is limited to lawful purposes including competition management, live timing synchronization, ranking computation, and archival storage.


17. Data Localization Policy

AQUANExT™ maintains primary hosting infrastructure within India for competition data processing.

Where required by law or contractual obligation, personal data shall remain stored and processed within India.


18. Mandatory Data Processing Agreement (DPA)

Acceptance of AQUANExT™ Terms constitutes acceptance of a binding Data Processing Agreement between the organizer (Data Controller) and AQUANExT™ (Data Processor).

Processing shall occur strictly under documented competition-related instructions.


19. Platform Security Standards

AQUANExT™ implements commercially reasonable safeguards including:

20. Log Retention & Forensic Cooperation

Structured logs including mobile timing submissions, administrative actions, and authentication attempts are retained for system integrity, dispute resolution, and compliance purposes.

21. Regulatory Audit Cooperation

Where legally required, AQUANExT™ may cooperate with competent regulatory authorities regarding data protection compliance.

Primary regulatory obligations remain with event organizers acting as Data Controllers.
